August 16, 2010: LAW FIRM OF DAVID G. SIGALE, P.C. FILES NEXT CHALLENGE IN SECOND AMENDMENT LITIGATION
Attorney David G. Sigale is proud to once again team up with Alan Gura of Alexandria, Virginia, the Second Amendment Foundation of Bellevue, Washington, and the Illinois State Rifle Association, to argue that the City of Chicago’s new firearms ordinance, which bans firearms ranges that law-abiding persons would use for training and practice in order to better protect themselves, is unconstitutional under the First, Second and Fourteenth Amendments. Plaintiffs also include Rhonda Ezell, William Hespen and Joseph Brown, who are Chicago residents burdened by the City’s infringement. Action Target, Inc., a Utah company and a specialist in the construction and operation of safe, effective firearms ranges, is also a named Plaintiff in the case. June 28, 2010: HISTORIC VICTORY IN McDONALD CASE
IRSA Press ConferenceThe Supreme Court has today ruled in favor of the Plaintiffs in McDonald v. City of Chicago, represented by the Law Firm of David G. Sigale, P.C. and Alan Gura of Gura & Possessky, PLLC. The Supreme Court ruled that the Second Amendment applies fully and equally to federal, state and local governmental action. The Firm will continue to prosecute this matter to ensure that the Constitutional right to self-defense with a firearm in one’s home is protected.

Following the opinion, David G. Sigale addressed the media at the Illinois State rifle Association press conference.

David G. Sigale today gave a presentation to the Chicago Bar Association’s Municipal Law Committee regarding the upcoming decision in McDonald v. Chicago, including the Constitutional issues raised in the case, and the practical effects of the possible outcomes.


November 30, 2009: SUPREME COURT ARGUMENT DATE SET IN McDONALD CASE
The Supreme Court has set the morning of March 2, 2010, as the date it will hear arguments in the case of McDonald v. City of Chicago, which tackles both the Second Amendment’s applicability to state and city governments, and the Fourteenth Amendment’s long-minimalized Privileges or Immunities Clause. The Court’s eventual decision will affect not only the Second Amendment, but also potentially the Bill of Rights as a whole.


November 16, 2009: LAW FIRM OF DAVID G. SIGALE, P.C. FILES PETITIONERS’ BRIEF TO SUPREME COURT IN McDONALD CASE

November 13, 2009: LAW FIRM OF DAVID G. SIGALE, P.C. FILES CARPER REAL ESTATE ANTITRUST SUIT IN NEBRASKA FEDERAL COURT
Working with local counsel, the Firm has filed a lawsuit on behalf of a small realtor in Nebraska, seeking damages for federal antitrust violations and other business torts against several larger realtors and realtor associations. The suit was filed in United States District Court in Lincoln, Nebraska, and is entitled Progressive Buyers & Sellers LLC and Julie Carper v. Coldwell Banker Town & Country Realty of Kearney, LLC, et al.

September 30, 2009: UNITED STATES SUPREME COURT GRANTS PETITION TO HEAR McDONALD V. CITY OF CHICAGO
McDonald v. City of Chicago The United States Supreme Court has granted the Petition for Writ of Certiorari filed by Law Firm of David G. Sigale, P.C., who is co-counsel with Alan Gura of the Virginia and Washington, D.C. based Gura & Possessky PLLC. McDonald involves the applicability of the Second Amendment to the states and local governments, and will be a closely-followed case with far-reaching implications for the entire country. The briefing will be completed in January, 2010, with arguments in February, 2010. A decision is expected next June.

Speaking on the granting of the Cert Petition, David Sigale said: “The City of Chicago cannot take from millions of Americans the fundamental freedom of self-defense in one’s own home. We are confident the Court will stand on the side of the law-abiding citizens and the Bill of Rights.”

June 9, 2009: LAW FIRM OF DAVID G. SIGALE, P.C. FILES CERTIORARI PETITION TO U.S. SUPREME COURT IN McDONALD CASE
Working with co-counsel Alan Gura, the Firm has filed a Petition for Writ of Certiorari to the United States Supreme Court in the case of McDonald v. City of Chicago, asking the Court to rule that the Second Amendment applies to state and local governments, including the City of Chicago. The District Court deferred the matter to the Seventh Circuit Court of Appeals, and that Court recently ruled the issue must be decided by the Supreme Court.

David G. Sigale appeared at the first ever Second Amendment Freedom Rally at the State of Illinois Building in Chicago, along with the Plaintiffs in the McDonald v. City of Chicago case, States Attorney candidate Tony Peraica, numerous eloquent speakers, and hundreds of others, to voice their opinions in support of the Second Amendment and the people’s right to defend themselves in their home from harm. The stories told by the speakers during the Rally truly demonstrated the importance of this issue.

On June 26, 2008, on behalf of four Chicago residents, the Illinois State Rifle Association and the Washington state-based national organization Second Amendment Foundation, the Law Firm of David G. Sigale, P.C. filed suit against the City of Chicago and Mayor Richard M. Daley. The suit alleges that the City’s handgun ban, in effect since 1982, that prevents regular citizens from having a functional handgun in their homes for self-defense, as well as certain of the City’s registration requirements violate its residents’ Second Amendment rights.

This filing comes in the wake of the landmark District of Columbia v. Heller decision by the United States Supreme Court, which struck down the District’s handgun ban as an unconstitutional infringement on the Second Amendment rights of its law-abiding residents.

The Law Firm of David G. Sigale filed this suit with the Washington D.C. and Virginia firm of Gura & Possessky, PLLC. Alan Gura of that firm is the attorney who successfully prosecuted the Heller case and prevailed before the U.S. Supreme Court.

This Firm filed this lawsuit because it believes in preserving the citizens’ rights as affirmed in the Constitution and Bill of Rights, and because it believes law-abiding people should have the right to defend themselves and their families in their own homes.
