The Law Firm of David G. Sigale has recently filed an amicus brief with the United States Supreme Court in Viramontes v. Cook County, Illinois, on behalf of the Illinois State Rifle Association, and supporting the Petitioners in their challenge to the Cook County ban on semi-automatic rifles as a violation of the Second Amendment to the U.S. Constitution as per the Supreme Court’s Heller and Bruen decisions.
The brief discusses and challenges the Seventh Circuit Court of Appeal’s previous holdings regarding this topic, arguing the appellate court has created and followed standards for analyzing the issue that do not comply with the Supreme Court precedent. By implementing these incorrect standards, the Seventh Circuit has issued rulings which erroneously uphold the relevant firearm restrictions in violation of the Constitution. The Firm’s amicus brief urges the Supreme Court to reject the incorrect analyses repeatedly applied by the Seventh Circuit and instead apply the standards the Court itself has set out, as being more faithful to the Second Amendment’s original meaning.
