David G. Sigale, on behalf of Daniel Easterday, a resident of Deerfield, the Illinois State Rifle Association, and the Second Amendment Foundation, has filed a lawsuit in Lake County, Illinois, against the ban on certain semiautomatic rifles and pistols (which the law labels as “assault weapons”), passed by the Village of Deerfield. The lawsuit, alleges that the Village lacked the power to pass such an ordinance, because State law only allowed home rule municipalities such as Deerfield to pass such a law during a 10 day window in 2013. Then, Deerfield passed a different law, which merely regulated the possession of assault weapons.
This lawsuit alleges Deerfield is not empowered to make the radical change of banning assault weapons. This is especially true since the new Ordinance imposes penalties of up to $1000.00/day for violations, and confiscation and destruction of the firearms. “The Plaintiffs are law-abiding, vetted by the State, and do not deserve to be turned into criminals at the Village’s whim,” Sigale said. “We are confident the courts will agree that the Village exceeded its authority in passing a politically-expedient, yet illegal firearms ban.”
