As a firefighter, S.M. has dedicated his career to helping others and saving lives in his community. It is fitting to call him a hero. In addition, he is a family man and an all-around decent guy.
But in 1994, when he was 18, he got into a fight at a high school party that involved many persons. He ironically started out trying to break up the fight, but got sucked into it. The police came and arrested and charged S.M, who pleaded guilty to a felony. He received and complied with a sentence of probation, community service, $233.00 in restitution, and court costs.
In 2018, S.M. applied for a FOID card and was denied, based on the 24 year old conviction. Recently, the Firm represented S.M. in court on his FOID appeal, arguing that S.M.’s firearm rights should be restored, and that it was a substantial injustice he still be considered a dangerous person to anyone, decades and an entire adulthood later.
The court agreed with the Firm and S.M., and ordered that S.M.’s Second Amendment rights be restored and that the Illinois State Police issue him an FOID card. The correct and well-deserved result.
There are a lot of decent people out there who may not be hero firefighters, but who still lead law-abiding lives and take care of their families, and conduct their business, and serve their neighborhoods and communities, each in their own way. They are not dangerous to the public, but they are denied their rights because of an indiscretion in their distant past.
