Attorney David G. Sigale, in conjunction with attorneys for two other consolidated cases in the Seventh Circuit Court of Appeals, has filed for a full-Court, or en banc, review of the Court’s recent 2-1 panel decision in Bevis v. City of Naperville, which upheld the State’s ban on many semi-automatic firearms and magazines. The Firm represents the Plaintiffs in Harrel v. Raoul, which is consolidated with Bevis and four other cases in that Court. In asking the full Seventh Circuit to hear the case, Sigale and the other Plaintiffs’ counsel argue that the panel decision grossly contradicts the U.S. Supreme Court’s 2022 Bruen decision, which has set the standard for analysis in a Second Amendment challenge. “In deciding that the banned firearms are only suitable for military use and therefore are not protected by the Second Amendment at all, the panel has ignored Supreme Court precedent and replaced it with its own improper test,” Sigale stated. “We are hopeful the full Seventh Circuit or, if need be, the Supreme Court will reverse the panel’s error.”
