The Law Firm of David G. Sigale, P.C. has recently obtained a ruling that the Village of Deerfield exceeded its authority when it enacted an assault weapon ban (AWB) and large capacity magazine (LCM) ban. In Easterday v. Village of Deerfield, a Judge in the Lake County Circuit Court held the ordinances to be unenforceable and entered a permanent injunction against them. In 2013, the State of Illinois offered a ten-day window for municipalities that wished to pass such bans, after which time the firearms and magazines would be the exclusive province of state law, otherwise known as preemption. The court found that the Village missed this window, thus it was bound by state law. The Village argued it was allowed to amend its previous regulations on possession and transportation, but the court ruled this was not a proper amendment, but an improper new law altogether. The Village has not stated if it will appeal, and there was a consolidated case that is still pending on one of its legal claims, so stay tuned for possible future developments.
