Sigale Seeks U.S. Supreme Court Review in Harrel Rifle and Magazine Ban Case

Attorney David G. Sigale, has filed with his co-counsel a Petition for Writ of Certiorari before the United States Supreme Court, seeking review of the Seventh Circuit Court of Appeal’s 2-1 panel decision in Bevis v. City of Naperville, which upheld the State’s ban on many semi-automatic firearms and magazines. The firm represents the Plaintiffs in Harrel v. Raoul, which was consolidated with Bevis and four other cases in the Seventh Circuit. In asking the Supreme Court to hear the case, Sigale and co-counsel argue that the panel decision flatly contradicts the U.S. Supreme Court’s 2022 Bruen decision, which has set the standard for analysis in a Second Amendment challenge. “In holding that the banned firearms are only suitable for military use and therefore are not protected by the Second Amendment at all, the panel has misapplied the clear holdings of the Supreme Court and replaced them with its own improper test,” Sigale stated. “We are hopeful the Supreme Court will accept our Petition and reverse the panel’s error.” The Plaintiffs include one individual and two firearms dealers, plus the Illinois State Rifle Association, Second Amendment Foundation, and the Firearms Policy Coalition.
