Illinois Supreme Court Hears Felon Restoration Case

This past week, the Law Firm of David G. Sigale, P.C. co-presented the case of Evans v. Illinois State Police to the Illinois Supreme Court. The case seeks to reverse an Appellate Court decision holding that the FOID Card Act cannot be used to restore the firearm rights of felons. The Firm is arguing this is an absurd result that is completely contrary to both the Act’s intent and Illinois Supreme Court precedent.  

In an interesting twist, the State Police completely agrees with this position, and argued as such to the Court. In a second twist, the Appellate Court even noted the absurdity and possible unconstitutional nature of its ruling. Nonetheless, it felt constrained to rule against Mr. Evans by what it felt was the poor drafting of the State statutes. The Firm hopes the Court corrects this erroneous opinion, so that the rights of deserving individuals, who have proven that they have rehabilitated themselves since their long-ago offenses, can be restored.
